Any mediation, dispute, or court proceeding must be brought in the state or federal courts sitting in Timmins, Ontario, Canada, and you consent to the personal jurisdiction of those courts. Any claim must be brought within one year after the cause of action arises, or it will be forever barred. The prevailing party is entitled to recover reasonable legal fees and costs.

Because we work on a quote basis, the specific commercial terms of your order, including price, quantity, lead time, payment and delivery, are agreed with you in your quote and any related agreement before production begins, rather than through an online checkout. Pricing, taxes and delivery

The price, applicable taxes, shipping and any other fees for your order are set out in your quote or order confirmation. Additional shipping fees may apply if delivery cannot be completed, is refused, or the shipping address is incorrect.

Warranty

Products carry a 14-day warranty for defects in materials or workmanship. If you have a warranty claim, or you are otherwise dissatisfied with a product for something not covered by the warranty, contact us at info@josfactory.comand we will see what we can do to help. Except as expressly provided here, products are provided “as is” and JOS Factory disclaims all other implied warranties to the maximum extent permitted by law.

Damaged, defective or wrong items

Damaged on arrival: if products are damaged at the time of delivery, we will repair or replace them free of additional charge. Contact us at info@josfactory.com and we will coordinate the process.
Defective within warranty: if products are defective and still within the warranty period, we will repair or replace them free of charge, and we will pay return shipping.
Wrong item: if you receive an incorrect item, we will replace it free of additional charge.

Returns and custom products

All JOS Factory products are custom and made to order. Because of this, non-defective custom or personalized items cannot be returned or refunded. We accept returns or exchanges for custom items only if they are damaged or defective on arrival, if there is a manufacturing error, or if the item does not match the order.

Other sale terms

The limitation of liability, indemnification and dispute-resolution terms above apply to sales as well. Ontario, Canada law governs your purchase, and any proceeding must be brought in the courts sitting in Timmins, Ontario, Canada. These sale terms, together with the terms of your specific order, constitute the entire agreement for that purchase. JOS Factory may assign these terms and delegate any of its obligations.
